The recent constitutionality debate has sparked over the President's statements against the Defense of Marriage Act (DOMA), a federal amendment defining marriage as a union for all legal purposes, between a man and a woman, and allowing states the freedom to reject same sex marriages from other states. Like the federal doctrine, many states have even adopted their own Defense of Marriage Acts to prevent same sex civil unions from receiving equal marriage benefits as heterosexual couples.

Both the Department of Justice and the presidential Administration have withdrawn its defense of the Act, yet many opinions still form about President Obama’s unwillingness to include same sex couples in his definition of marriage. The Administration has taken the stance that DOMA is actually in violation of the constitution, since the US constitution contains no language that defines or regulates marriage.
